Actress loses recent child custody hearing

Many Connecticut readers are familiar with the hit television show "Gossip Girl." One of the actors from that show, Kelly Rutherford, has recently been dealt a terrible blow in her child custody fight with her former husband. The pair have been struggling in court for nearly six years over the care and custody of their two children, and in a recent action Rutherford asked that her children be returned to the United States and placed in her care.

The children have been residing with their father in France since a court hearing in 2012. When he left America to travel he was denied re entry upon his return. Since that time, Rutherford has had to travel to France in order to spend time with her children.

The childrens' father was ordered by the court to make application for a new visa that would allow him to come into the United States with the children. That was during the 2012 hearing, and the State Department told reporters that they do not have a visa application on file for him. The cost of the ongoing legal battles has led Rutherford to file for bankruptcy, although she has vowed to continue to fight for the return of her children.

International child custody struggles are not just limited to celebrities; there are many families in Connecticut and across the nation that encounter these types of legal battles. When children are removed from the country and living with a parent who holds citizenship in another jurisdiction, child custody matters can become incredibly complex. In this case, there is no debate on which country holds jurisdiction over the case, but rather a ruling that acknowledges that the father has custody of the children but is not allowed to enter the United States, leaving the mother with no choice but to travel overseas to spend time with them.
