Connecticut couples can now get divorced in 30 days
Due to a new Connecticut law that went into effect on October 1, some couples may now be able to complete their divorces in as little as 30 days. Previously, couples had to wait at least 90 days before they could dissolve their marriages – meaning divorces took at least three months, and, in many cases, much longer.
With the passage of this new legislation, however, couples can now fast-track non-adversarial, amicable divorces, but only if they meet several specific criteria, including:
- At least one spouse must be a resident of Connecticut
- The couple does not have any children together
- Neither spouse is pregnant at the time of divorce
- The couple has not been married for more than eight years
- Neither spouse owns real estate
- The total combined value of all property owned by both spouses is less than $35,000
This new process comes as welcomed news for many couples who simply want a quick and easy divorce.
Not everyone can use the new law though
Obviously, many divorcing couples in Connecticut will not be able to use the new streamlined divorce process, including those who own homes or have had children together. Also, if either spouse has a pension plan or a pending bankruptcy, Connecticut law expressly states they cannot take advantage of this new law.
In addition, even if you and your spouse meet all of the criteria mentioned above, you may still be ineligible for a 30-day divorce, especially if the two of you are unable to reach an agreement regarding all divorce-related issues, including property division.
Legal guidance is always a good idea
In any case, it is advisable to speak with an experienced attorney if you are involved in any type of divorce proceeding. Whether you are seeking a quick 30-day dissolution or believe mediation and/or litigation is necessary to resolve your divorce, a skilled and knowledgeable legal advocate can help explain your options and protect your rights.
Even if your divorce is an amicable one, you still need to consult with a lawyer. After all, how will you know if your divorce settlement is fair and equitable if you do not know your rights under Connecticut law?
