Understanding child custody modifications in Connecticut

The changes you experience in life are constant. While some changes may be planned for, others may come to you unexpectedly. If you are navigating a significant change in your circumstances, you may request the Connecticut courts for an update of your custody order.

When can I modify my custody order?

Under Connecticut law, you or your ex can file a “motion for modification” for your existing custody order if there has been a notable change in either of your situations. These factors may include:

  • When you or your ex moves to a different state for a job opportunity
  • When you or your ex experiences a serious health issue

It is important to remember that your request must include valid proof for your reason of modification. Additionally, your request must be fair for both parties and be able to serve your child’s best interests.

How do courts determine the child’s best interests?

There are a total of 17 statutory factors that Connecticut family courts consider when determining your child’s best interests. Eight of these factors include:

  • Your child’s physical and emotional well-being
  • Your child’s developmental needs
  • You and your spouse’s personal relationship with your child
  • You and your spouse’s ability to be involved in your child’s life
  • You and your spouse’s mental and physical health
  • You and your spouse’s respective wishes on custody
  • Your child’s adjustment to their school and community environments
  • If there is evidence of child neglect or family abuse

Also, if your child is mature enough to express a choice in custody, the judge will listen to their perspective and consider this along with the other defining factors mentioned above.

You and your child will be okay

By understanding your rights and following the proper legal procedures, you can file your petition with minimal hurdles and adjust to your new situation with better flexibility.
